Aircraft Vibes App Terms of Use

1. About these Terms

These Terms of Use ("Terms") govern your use of the Aircraft Vibes mobile application for iOS and Android (the "App") and its connection to the Aircraft Vibes flight display device (the "Device"). The App is provided by Reklamos Principas, MB, company code 304813538, Odminių g. 1A-15, LT-01122 Vilnius, Lithuania ("Aircraft Vibes", "we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, to set up and configure your Device, in line with these Terms and, where applicable, the usage rules of the Apple App Store or Google Play.

3. What you may not do

• Copy, modify, decompile or reverse engineer the App, except where the law expressly allows it.
• Access our servers other than through the App or the Device, or send automated requests that overload them.
• Extract, resell or redistribute flight data or map content shown in the App or on the Device.
• Use the App for any unlawful purpose.

4. Maps

The App shows a map so you can choose the area your Device watches. The map provider depends on your phone's operating system:

• Android: the App uses Google Maps. Your use of Google Maps features and content is subject to the current versions of the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
• iOS: the App uses Apple Maps (Apple MapKit), provided by Apple as part of iOS. Apple's handling of map data is described in the Apple Privacy Policy.

We may suspend access to map features if the applicable map provider's terms are breached.

5. Flight data is for information only

Flight information is based on publicly broadcast aircraft data from third-party sources. It may be delayed, incomplete or inaccurate, and some aircraft may not be shown. The App and the Device are for personal information and entertainment only. Do not use them for navigation, aviation safety, air traffic or any operational decisions. Third-party data sources may change or become unavailable, and we may change which sources we use.

6. Your Device and network

You are responsible for the security of your Wi-Fi network and the phone you use with the App. The Device needs an internet connection to show flights.

7. Updates and availability

We may update, change or discontinue features of the App or the service it relies on. Where a change significantly and negatively affects the core functions of the Device, we will make reasonable efforts to inform you in advance.

8. Privacy

Our App Privacy Policy explains how we process personal data in connection with the App and the Device.

9. Intellectual property

The App, including its design, software and content (except third-party content such as map and flight data), belongs to us or our licensors. These Terms do not give you any ownership rights.

10. Warranties

The App is provided free of charge "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be uninterrupted or error-free. Nothing in these Terms limits your statutory rights as a consumer, including your rights relating to the Device under our store policies and applicable consumer law.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss caused by inaccurate flight data or third-party services. Nothing in these Terms limits liability for death or personal injury caused by negligence, for intentional misconduct or gross negligence, or any other liability that cannot be limited by law.

12. Ending use

You can stop using the App at any time by uninstalling it. We may suspend or end your access if you seriously breach these Terms.

13. Apple App Store users

If you downloaded the App from the Apple App Store:

• These Terms are between you and Aircraft Vibes only, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection or privacy laws.
• Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the App infringes that third party's intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms when using the App, including your wireless data service agreement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Lithuania. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in the courts of that country.

15. Changes to these Terms

We may update these Terms. We will publish the new version on this page with a new "Last updated" date and, for significant changes, inform you in the App. Continuing to use the App after changes take effect means you accept them.
